Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the FinallyStaff platform (the "Platform"), including any websites, application forms, candidate portals, and related services operated through it. By creating an account, accessing the Platform, or submitting a job application, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference.

If you do not agree with any part of these Terms, you must not access or use the Platform or submit an application through it.

You must be at least the age of majority in your jurisdiction, and otherwise legally permitted to seek or accept employment, in order to submit an application or create an account. By using the Platform, you represent and warrant that you meet these requirements and that you have the legal right to provide the information and documents you submit.

You are responsible for the accuracy, completeness, and lawfulness of all information you provide, including your name, contact details, work history, qualifications, identification documents, and any other materials you upload or submit.

You agree to keep your account credentials confidential and not to share them with any other person. You are responsible for all activity that occurs under your account. You must notify us promptly if you believe your account has been accessed without your authorization.

Providing false, misleading, or fraudulent information may result in the rejection of your application, suspension or termination of your account, and, where applicable, withdrawal of any offer of employment.

When you submit an application, the information and materials you provide are made available to the recruiting organization and its authorized personnel for the purpose of reviewing your candidacy, communicating with you, and managing the hiring process.

Hiring decisions are made by the recruiting organization. We provide the software used to collect, organize, and manage applications, but we do not make hiring decisions on your behalf or on behalf of any employer.

We may suspend, restrict, or terminate access for any account that we reasonably believe is engaged in any of the conduct described above, or that violates these Terms or applicable law.

When using the Platform, you agree that you will not:

• Submit information that is false, fraudulent, misleading, or that you do not have the right to provide;
• Upload or transmit any content that is unlawful, infringing, defamatory, or that contains viruses, malware, or other harmful code;
• Impersonate any person or organization, or misrepresent your affiliation with any person or organization;
• Attempt to gain unauthorized access to any part of the Platform, other accounts, or connected systems;
• Interfere with, disrupt, or place an unreasonable load on the Platform or its infrastructure; or
• Use the Platform for any purpose that is unlawful or prohibited by these Terms.

You retain ownership of the content and materials you submit. By submitting content through the Platform, you grant the recruiting organization and us a limited, non-exclusive license to store, process, and display that content solely for the purposes of operating the Platform and supporting the recruitment and hiring process.

All software, design, text, and other materials that make up the Platform itself remain the property of FinallyStaff or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written permission.

We treat the personal information of applicants and employers as confidential and apply reasonable administrative, technical, and organizational safeguards to protect it. The collection, use, retention, disclosure, and protection of personal information are described in our Privacy Policy, which forms part of these Terms.

We do not sell your personal information, and we do not share it with third parties for their own marketing or advertising purposes. Please review the Privacy Policy for full details.

We may modify, update, suspend, or discontinue any part of the Platform at any time, including for maintenance, security, or compliance reasons. We do not guarantee that the Platform will be available without interruption or free of errors.

We may revise these Terms from time to time. When we make material changes, we will update the "Last updated" date below. Your continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.

The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we disclaim all warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant or guarantee any particular hiring outcome, employment offer, or response to your application. Participation in a recruitment process does not create any employment relationship unless and until a formal offer is made and accepted.

To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the Platform. Our total liability for any claim relating to the Platform is limited to the amount, if any, that you paid to us for use of the Platform.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

You agree to indemnify and hold harmless FinallyStaff, the recruiting organization, and their respective personnel from any claims, liabilities, damages, and expenses arising out of your breach of these Terms, your misuse of the Platform, or your violation of any law or the rights of any third party.

You may stop using the Platform at any time. We may suspend or terminate your access to the Platform if you violate these Terms, if required by law, or if necessary to protect the security or integrity of the Platform. Provisions that by their nature should survive termination — including those relating to intellectual property, disclaimers, limitation of liability, and indemnification — will continue to apply after termination.

These Terms are governed by the laws applicable to the recruiting organization operating this instance of the Platform, without regard to conflict-of-laws principles. Any disputes will be subject to the jurisdiction designated by that organization, except where applicable law provides otherwise.
